The primary purpose of the bill (Reg. No.8459) is to delineate supervisory functions between the executive authorities the State Sanitary and Epidemiological Service, the State Veterinary Service, and the State Technical Regulation Service to fix specific authorities in compliance with the Constitution of Ukraine. The bill also prevents the state from losing its supervisory functions over the safety of foodstuffs to protect consumer rights. The bill harmonizes the terms ‘standard´ and ‘technical regulations´ with the applicable laws, the Agreement on Technical Barriers to Trade and the WTO Agreement on Sanitary and Phyto-Sanitary Measures.
Provisions of the bill on sanitary and phyto-sanitary control meet article 5 of the Agreement on Sanitary and Phyto-Sanitary Measures, while the suggested amendments in part of labelling, any warnings and instructions for its use and disposal and any other indication or information regarding the product conform to Article 2 of the Directive 2001/95/EC of the European Parliament and of the Council of 3 December 2001 on general product safety.
